1. Agreement to terms

By accessing or using FARABEL (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. FARABEL is operated by Inevara Pty Ltd ("we", "us", or "our").

2. The platform

FARABEL is a marketplace that connects travellers ("Consumers") with independent travel professionals including travel advisors, tour guides, experience curators, and travel photographers ("Guides"). We provide the technology to facilitate these connections but are not a travel agency and do not directly provide travel services.

3. Account registration

You must be at least 18 years of age to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration and keep it up to date.

4. Consumer responsibilities

  • Provide accurate travel preferences and requirements to facilitate meaningful matches.
  • Communicate respectfully with Guides through the Platform.
  • Honour confirmed bookings or cancel with reasonable notice.
  • Pay all fees associated with bookings as agreed with the Guide.
  • Leave honest, good-faith reviews based on your actual experience.

5. Guide responsibilities

  • Hold all required licences, registrations, and insurance for the services offered.
  • Provide accurate profiles, credentials, and pricing information.
  • Deliver services as described and agreed with the Consumer.
  • Comply with applicable laws and regulations in each jurisdiction they operate.

6. Payments and fees

Payment terms are agreed directly between Consumers and Guides. FARABEL may charge platform fees as disclosed at the time of booking. All fees are in Australian Dollars (AUD) unless otherwise stated. Platform fees are non-refundable unless otherwise required by applicable consumer protection law.

7. Prohibited conduct

You must not:

  • Use the Platform for any unlawful purpose.
  • Post false, misleading, or defamatory content.
  • Circumvent the Platform to conduct bookings or payments off-platform to avoid fees.
  • Attempt to gain unauthorised access to any part of the Platform or its systems.
  • Harass, threaten, or discriminate against any user of the Platform.

8. Limitation of liability

To the maximum extent permitted by law, Inevara Pty Ltd is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or the services provided by Guides. Our total liability to you for any claim shall not exceed the fees paid by you to us in the 12 months preceding the claim.

Nothing in these Terms excludes any liability that cannot be excluded under the Australian Consumer Law.

9. Intellectual property

All content on the Platform, including the FARABEL name, logo, design, and software, is owned by Inevara Pty Ltd or its licensors. You may not reproduce, distribute, or create derivative works from Platform content without our written permission.

10. Termination

We may suspend or terminate your account at any time for breach of these Terms or for any conduct we determine to be harmful to other users or the Platform. You may close your account at any time via your account settings.

11. Governing law

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.
